IN INCOME TAX RULES IT IS PRESCRIBED THAT THE VALUE OF PROGRESSION'S GOOD WILL IS ABSENT SO NO CAPITAL GAIN IS TAXABLE.
SO IS SOMEONE CAN SAY THAT IT IS NOT A CAPITAL ASSET.

Can you provide the facts (Without disclosing the names?) You are asking the same question again and again....so in stead of being ABSTRACT...let us come to some figures...... Say for XYZ and associates, a chartered accountant profession......and like this..so on so forth
