I want to know the scope of Sec. 45(4)in case of firm.
(1) what is the meaning of the term used in the above section- "distribution of capital assets on the dissolution or otherwise".
does it mean distribution to
(i)partner only or
(ii) anyone ( e.g. creditor for settlement of their debt.)
by the way, as per ICAI modules, it includes the case of business acquired by the company on dissolutin of firm, except the cases where condtions of sc.47(xiii) is satisfied.
(2) what does "on dissoltion or otherwise" mean?
does it mean that - sec. 45(4) attract even in case of transfering asset by a firm , while it is in operation (i.e. not in the process of dissolution)

I am doing three different prop concern. I am filed my income tax retun in 2 months before for the asseement year 2009-10 with my my 2 prop concern income only. Because at the time return filing my 3rd concern accounts not finalised.But my bankers wants urgently i do that.Now i wants to file my revised return with my all 3 prop concern.my gross receipts not exceed rs.10 lacs.In this situation any problems created by the assessing officer at the time of assessment.Please advise me what i do?

Dear Sir,
we are working as a contractor and We are registered under Works Contract tax in Haryana.Which is @4%. Our Contract are inclusive of Service Tax and Works contract tax.The contractee is deducting & depositing works contract on Service Tax also. We have filed the return by claiming refund of excess works contract tax paid on service tax. Now the assessing officer is not giving the refund by claiming that the works contract is on payment recieved, whether it is service tax.Please clarify it whether we are eligible for refud or not by considering that the service tax is indirect tax and to be deposited to govt. account.
