Adjustment of refund against previous demand

27 December 2012 For one of my client has 250000 refund during the FY 10-11. But this refund amount has been adjusted against arrears amount outstanding in his account for FY 2007-08. In FY 2007-08 demand notice has been raised by income tax department and we submitted the required document and assessment also completed after detailed hearing. Can you guide me how to solve this issue.

27 December 2012 First of all you write to ITO to give effect of scrutiny assessment for 2007-08 and cancel the demand from their record.

After that if you have filed return of 2010-11 electronically, so talk to cpc banglore on toll free number 1800-425-2229 and ask them to reissue adjusted demand.

if you have not file your return of 2010-11 electronically, then simply write to ITO to issue fresh refund to your client and provide them required documents.

27 December 2012 File 154(1) rectification with the details regarding completion details of previous demand. And ask for issue of demand for the present year.
