Seeks to further amend three Customs notifications namely 104/2009-Cus, 16/2015-Cus and 17/2015

Notification No. 52/2016-Customs

New Delhi, the 23rd September, 2016

In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following amendments in each of the notifications of the Government of India in the Ministry of Finance (Department of Revenue), specified in column (2) of the Table below, which shall be amended or further amended, as the case may be, in the manner specified in the corresponding entry in column (3) of the said Table, namely :-

1.	104/2009-Customs, dated the 14th September, 2009, vide number G.S.R. 674(E), dated the 14th September, 2009.	In the said notification, in the opening paragraph, in condition (2), the words, brackets, figures and letters “or sub-paragraph (3) of paragraph 2 of notification No. 16 of 2015-Customs, dated the 1st April, 2015 or first proviso to sub-paragraph (1) of paragraph 2 of notification No. 17 of 2015-Customs, dated the 1st April, 2015” shall be omitted.
2.	16/2015-Customs, dated the 1st April, 2015, vide number G.S.R. 252(E), dated the 1st April, 2015.	In the said notification, sub-paragraph (3) of paragraph 2 shall be omitted.
3.	17/2015-Customs, dated the 1st April, 2015, vide number G.S.R. 253(E), dated the 1st April, 2015.	In the said notification, proviso to sub-paragraph (1) of paragraph 2 shall be omitted.

(1) The principal notification No. 104/2009-Customs, dated the 14th September, 2009 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 674 (E), dated the 14th September, 2009 and was last amended by notification No. 36/2016-Customs, dated the 1st June, 2016 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 569 (E), dated the 1st June 2016.

(2) The principal notification No. 16/2015-Customs, dated the 1st April 2015 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 252 (E), dated the 1st April 2015 and was last amended by notification No. 36/2016-Customs, dated the 1st June, 2016 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 569 (E), dated the 1st June 2016.

(3) The principal notification No. 17/2015-Customs, dated the 1st April 2015 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 253 (E), dated the 1st April 2015.
