CBDT's CLARIFICATION ON EXTENSION OF DUE DATE OF FILING OF RETURNS
PRESS RELEASE [NO. 402/92/2006-MC (20 OF 2012)], DATED 1-8-2012:-
A section of Media has reported that the Central Board of Direct Taxes has extended 'due date' of
filing of returns to 31st August, 2012 in respect of only those returns which were to be e-filed by
31st July, 2012. It is clarified that the notification issued by the Board on 31st July, 2012 has
extended the 'due date' of filing of all returns for the Assessment Year 2012-13 which were due to be
filed by 31st July, 2012 to 31st August, 2012.
one must read the two words 'such returns' in the s.119 order meaning the income tax returns for A Y 2012-13 in the words preceding to such words ' such returns' in the order to gain an understanding that the extension apply to all those who r required to file return u/s 139(1) by July 31st. so it is not that the extension id only for those subject to e-filing but for all. gopal nathani
thank update information
in the CBDT order the word such is not prefixed to the word assessees and further it is prefixed to the due date so that it is to be understood as extending date in all cases which have july 31syt as due date. the government website efilingindia.gov.in statement is categorical on this. gopal nathani
The word SPECIFIED CATEGORY is mentioned only in the reasons for extending the due date. If at all the extension is for only for SPECIFIED CATEGORY they might have clearly mentioned.
It is for all assessees who are liabe to file on or before 31st july.
Please have a clear study of the order Link: http://www.incometaxindia.gov.in/archive/BreakingNews_Section119_31072012.pdf.
Nobody yet clear about the same that whether its applicable to all assessees or only to that assesses for whom its mandatory to file e-return i.e. whose income cross 10 L.
Can anyone concerned authority will clarify the same?
confusion to hai boss!!
