Delhi High Court Denies Plea to Reschedule CA May 2024 Exams Amid Lok Sabha Elections

Last updated: 09 April 2024

The Delhi High Court has dismissed a petition seeking the rescheduling of the Institute of Chartered Accountants of India (ICAI) CA Inter and Final examinations for May 2024. Despite concerns raised by petitioners regarding potential clashes with the Lok Sabha elections, the court ruled in favor of maintaining the previously announced exam schedule. Consequently, ICAI is poised to proceed with exam arrangements as planned.

Court's Decision and Rationale

Justice C Hari Shankar, presiding over the case, rejected the plea put forth by 27 candidates to postpone the CA exams from May to June due to the Lok Sabha elections. The bench clarified that there exists no legal impediment to conducting exams during election periods. Moreover, they questioned the validity of the request for rescheduling, emphasizing candidates' capacity to manage their studies amidst election activities. Notably, the court expressed astonishment at the plea, particularly in light of the significant number of candidates - approximately 4,26,000 expected to appear for the exams.

Delhi High Court Denies Plea to Reschedule CA May 2024 Exams Amid Lok Sabha Elections

Exam Timetable Adjustments

Despite the dismissal of the rescheduling plea, ICAI has made minor adjustments to the exam timetable to avoid potential clashes with the Lok Sabha elections. The CA intermediate and final exams will proceed as scheduled, with slight modifications. Notably, the dates for certain exam groups have been revised to accommodate the election schedule.

  • CA Intermediate Group 1 exams: May 3, 5, and 9 (previously May 7)
  • CA Intermediate Group 2 exams: May 11, 15, and 17 (previously May 9, 11, and 13)
  • CA Final Group 1 exams: May 2, 4, and 8 (previously May 6)
  • CA Final Group 2 exams: May 10, 14, and 16 (previously May 8, 10, and 12)

Student Dissatisfaction and Advocacy Efforts

While the court's decision aligns with legal provisions, CA aspirants express dissatisfaction with the altered exam timetable. Advocates for rescheduling highlight concerns related to transportation and potential disturbances during the elections. Notably, child activist Anubha Srivastava Sahai is supporting CA students in presenting their case before the court.

ICAI's Future Plans

In a significant announcement, ICAI revealed plans to increase the frequency of CA Foundation and Inter exams to three times a year, departing from the previous biannual schedule. This decision aims to enhance flexibility and accessibility for aspiring chartered accountants. The new exam pattern will undergo a pilot run initially at the Foundation and Intermediate levels, with implementation expected following the conclusion of the May exams.

Conclusion

The Delhi High Court's decision to uphold the May 2024 exam schedule underscores the importance of adhering to established timelines while accommodating legitimate concerns. Despite initial opposition, ICAI's commitment to ensuring smooth exam proceedings remains unwavering. As CA aspirants prepare for the upcoming examinations, ongoing advocacy efforts and institutional reforms aim to foster a conducive environment for professional development within the accounting community.
