P.C: 1. Heard. Rule. To be heard along with Writ Petition No.963 of 2008.

2. As regards the interim relief, we do not find any prima facie case having been made out for grant of any interim relief as such in the matter. As already recorded in the order passed today in Writ Petition No.963 of 2008, the respondent No.3 herein, who is one of the members of the inquiry committee has expressed her desire to recuse herself from being a member of the inquiry committee. We find no prima facie material placed on record to substantiate the contention about bias attitude on the part of the members of the inquiry committee in the matter of inquiry which is in progress by the Commission. Hence no interim relief.

3. We make it clear that we have not expressed any opinion as regards the inquiry which is said to have been commenced by the management of the petitioners in relation to the complaint which was lodged by the respondent No.5.
