Does it mean that Unlisted companies proposing to pay more than 198 limits will fall under Inadequate Profit category of Schedule XIII.?

Can Unlisted Companies pay remuneration in excess of 198 limits (i.e.more than 11%) without central Govt approval,subsequent to MCA circular dtd 08/02/2011 changing Schedule XIII ?
