We sold the goods tax lavied, but the party refuse to accept the goods, what treatment we made at this point?

As per rule 16 of CER, you can consider such returned goods as inputs and avail cenvat credit on the same just like any other inputs on the basis of invoice from the person who has returned or on the basis of your invoice. Refer rule 16
