Dear TDS rate is based on the nature of payment and tds calculated on basic value (without including service tax) i.e. on 65000/- if invoice value excluding service tax and on 57850/- (65000*100/112.36) if invoice value is including service tax.

Thank you for replied,

But you did not say ,  what will become the TDS amount .

What is nature of payment professional fees, commission, rent or any other???

if service Tax is Shown Seprately then you are required to decduct TDS on Invoice value excluding Service Tax

okay, thank you shubham sir,

My problem is ,

Ihave a service invoice , take for example of,

we have given to X company service invoice ,

ie,                  service Rs=  65000

      service tax @ 12.36%=  8034

                           total =      73034

what will be the amount of we required to deduct from them. or from X company

On basic amount i.e. on 65000/- Rs.

yes basic amount is 65000

on service tax  is   @ 12.36%

caluclate then it will become 73034, i got a confusion in that , what will be the TDS  we need to deduct from them. some one saying 1300 is TDS deducted amount

Yes Rs 1300 if invoice is for Contract

TDS to be deducted by You on Rs. 65000/-

194 C  applies- Assuming your service provider is offering Annual contractual services.

IF your Service provider is ,

1. Individual - deduct Rs.650/- @ 1%

2. Firm/Company- deduct Rs. 1300/- @ 2%

Hope your query is solved here.

65000*2%= 1300

Yes 65000*2% as i explained above.
