Tax demand in e portal

417 views 4 replies

My daughter has a tax demand of 44000/- on e portal for her ITR of AY 2009-10. In the tax computation sheet they have not taken into consideration home loan interest of rs 150000/- and tax computed is 108000/.But TDS Iis 80000/-. They have added interest under sec234 a b c.Unfortunately my daughter has not kept the copy of ITR only has acknowledgement. Is their any chance of rectification? Also is Tax demand on the portal final or they will formally send a demand notice? will their be further interest on the demand if she waits for formal notice?

Did your daughter filed itr manually or efiled the itr?

If efiled, you can check the itr filled on the dashboard of the efiling portal for the relevant ay.

Check form 26AS of the relevant ay. It can be available from efiling website itself. Interest u/s 234 A is applied because belated return is filed. However in case of home loan interest not considered you can file a response to o/s tax demand and go for demand disagree.

Can you please provide the extract of the demand order and intimation u/s 143(1) here so as to recalculate the taxable amt if any

A/Y         SECTION            DIN         DATE OF DEMAND RAISED                O/S  UPLOADED BY                RECTIFICATION RIGHTS     RESPONSE

2009/10     142(1A)                              27-3-2012                                           Jurisdictional AO                              Assessing Officer

My daughter has not got any demand notice by post she came to know about this demand only on 19-10-2015!.Does she have to pay interest from 27-3-2012? Unfortunately she has filed manually and does not have a copy. only acknowledgement. Advise us please

Omitted out standing inthe previous thread it is Rs 44280/-

Interest has already been charged. It is been charged from date of filing return to date of demand order. Check form 26AS and see the tds and advance tax, SA tax amt. You need to file a response for o/s demand and go for demand disagree and for reason you can say home loan interest not considered.

Regarding total tax demand I can only tell you if I get all details regarding date of return filed. Her income from all sources, investments claimed, home loan interest, sa tax, advance tax and tds amt details.
