29 August 2011whether service tax can be considered during tax audit................our client has not paid service tax on job work done by him...he didn't charged it from the party but he is covered under service tax provisions......what are the reporting requirements.......the client is a partnership firm...........

First of all we have to see, whether the firm is registered under service tax ?
If yes, then calculate the service tax payable and allowed /dis allowed depends upon u/s 43B.

If firm is cross the turnover liable to service tax, then the film is liable to pay the service tax weather collected or not service tax amount.

The firm has to take service tax no if limit cross 9,00,000 and after reaching 10,00,000, Firm has to pay service tax.
Please correct me if i am wrong
