Service tax

For Website designing, is we need to send the Invoice to customer including service Tax?

for example total invoice amount will be Rs.40,000/- is they need to add service tax to customer?

or below calculation is ok to pay?

40000 minus 10% TDS = 36000, please confirm

Any service which is not in the negative list has to be charged service tax. Please check whether your turnover has crossed the basic exmeption limit of 10 lakhs, and whether you have a service tax registration. and in case yes, then you need to charge service tax on the above.

BUT I THINK THANT AT FIRST CHECK YOU TERMS AND CONDITION OF DUTIES AND TAXES POINT IN YOU WORK ORDER

IN YOUR WORK ORDER IF YOUR RATE IS EXCLUDING OF SERVICE TAX THAN YOU CAN CHARGE SERVICE TAX OTHERWISE NO

OTHERHAND IF YOU ARE RUNNING WEBDESIGN SERVICE , YOU SHOULD TAKE SERVCE TAX REGISTRATION NO.

TDS SHOULD BE DEDUCTE 10% UNDER SECTION 194J

In your invoice, need not to consider TDS, it will be deducted by the customer.

Your concern should be whether to charge service tax or not. If you are registered then service tax will be applicable otherwise not applicable.

For software/website designing- if u are designing customized one i.e as per the needs of customer then u have to pay service tax whereas if it is readymade one then no need.
