Section 89 relief - Help requested

Tax queries 313 views 6 replies
My tax consultant has prepared and submitted for 10E form me. I observed that the amount shown at 1a in form 10E (Salary received in arrears or in advance in accordance with the provisions of sub rule(2) of rule 21A) is different than the amount shown by him in item 2 of Annexure A of the submission. The amount in item 2 of Annexure A however matched exactly with column 3 of Table A. Can this be correct ? The amount at 1a in 10E is higher. If this is incorrect filing, how can I rectify it now? Form 10E issued by my office has many discrepancies and internal anomalies, hence my tax consultant has prepared 10E using my Form 16 & arrears sheet.

to get benefit under section 89(1) ,Form 10E should be filed online by income tax login/account
no problem ,if  your consultant has given form 10E with some mistake
then you may upload correct form 10E to get benefit

As for how he reached the figures and why is it different, may be that he considered some exemptions or actual credit etc

Okay, but then does it mean that these items may differ in value in Form 10E. In that case, will it not attract notice / show cause, because substantiating such difference, if any, is also necessary.

In such case will the return be kept pending by department ?

I dont think so ordinarily it should be different, all these 3 figures mentioned by yu should be same, only he has the reason to eplain why he changed one. If he is unable to explain, please fill the correct one and the resubmit.

Sir, employee gets his figure of taxable income through TRACES. Like wise, can he get "figure of salary received in arrears- as uploaded by employer" from TRACES ?

There is huge confusion about exact amount of salary received in arrears ( because of doubt on whether exemptions under section 10 to be spread through previous years etc ), hence this query.

Hi Sameer, its not obligatory on Employer to upload salary breakup in TRACES. They have to issue you a seperate salary breakup certificate as only they knoww your entitelment and what has been given. Meet their accountant who has done the calculations, you also prepare an approx calculation sheet as per salary you were supposed to receive and then do one to one discussion.
