Salary income by ordinary resident from usa and india

Dear Sir\Madam,

If any individual who receive salary in india for 9 month then after he receive salary in USA for remaining 3 months then how can calculate his salary whether USA salary taxable in India ?

Yes, such person would be resident and ordinarily resident, in which case, salary income from USA (along with salary income from India) is taxable in India. However, in respect of income on which tax is paid in USA (on US income), you may claim relief u/s 91 as per DTAA.

You will be taxed here but can claim relief under DTTA, use ITR2A

Dear sir\Madam,

Thanks for reply. Please suggest me how can i take relief u\s 91 as per DTAA . Please suggest procedure.please suggest which document required for taking relief i.e. FORM 16 in India.Whether Tax resiliancy certificate required.
