Refund of tds for py 12-13

sir/Madam, the assessee has not filed ITR for py 12-13. tds u/s 94h deducted. is it possible to get refund of that tds in py 15-16 by filling first time itr for py 12-13 on 31.3.16??

Even if you file the return it will be belated return and you cannot claim refund on belated return....

Please find herewith a draft letter [sample ] for applying under condonation of delay for filing delayed return. You can file return from AY 2009-10 to present under circular 9 dated 9/06/2015. But first you have to take permission for filing return.

Please change the comm jurisdiction, ward no, Ay year etc which is relevant to you.
