Yes, As per section 174(4), Read with SS1, HOLDING ADJOURNED MEETING IN THE NEXT YEAR WILL BE CONSIDERED AS THE FOURTH MEETING IN A PREVIOUS YEAR, BECAUSE SECTION 174 CLEARLY SAY THAT MEETING SHALL AUTOMATICALLY STAND ADJOURNED TO THE SAME DAY AND TIME IN NEXT WEEK.
NO, THERE IS NO CONTAVENTION OF SECTION 173, BECAUSE MEETING HAS BEEN ADJOURNED BECAUSE OF LACK OF QUOROM AND THERE IS THE VALID JUSTIFIABLE REASON.
