Tds is not deducted in the payment of transportation charges with subject to PAN no. is it mention in the tax audit report ??

TDS has to be deducted @ 20%

But the assessee is not liable to deduct tds

Assess not liabile for deduction when he is having valid PAN. Otherwise Assess is liable for deduction of TDS

Okk then where it is mention in tax audit reportthat the transporter is not liable to deduct tds and having valid pan no ....

Its in income tax act .. TDs at 20% under section 206AA if pan not provided

Dear Krishna,

This is a case of transpoter, where TDS is not to be Deducted on the payments made to them if only they provide you with the PAN details otherwise it will be deducted @ 20%.This is applicable from 01.04.2009.this will be reported under the poin no 34a of the form 3CD.
