I received communication from the income tax department u/s139(9). How to corrrect and upload corrected XML. How can I download the defected XML.

The defective X M L can be downloaed from E-filing Website after loging into Asseesee Account.

For correction of this defective return, you need without out the error code which is reflected in Notice u/s 139(9) and after solving that a new X M L is required to be generated under section 139(9) [ Select this option in place of Section 139(1) ].

This corrected X M L is to be uploaded like normal return.

These days many of the assessees are receiving Notice u/s 139(9) for defective return due to nil income and refund claimed or any other may be.

But it has been seen that CPC process the same in a few days without any action.

So please wait for a while and then file reply to 139(9) notice and upload the X M L.

Hello,

I have filed the returns using ITR 4 form before the due date in mid-July.

On the incometaxindiaefiling.gov.in website, I see under Dashboard - Pending Actions there is a defect u/s 139(9) in my return. But till date, I have not received any notice via email. I am not able to upload the new XML because I don't have the PIN and other details that come with the notice.

Please let me know what I should do. Should I just wait for the IT Dept to send me the notice via email ??
