Dear All...

Greeting of the day...!!!

I m working with the Getwell Pharmaceuticals (1985) a proprietorship concern and we have also a co. Getwell oncology Pvt ltd (2010) now we want to merge both the entites to form a new co. Getwell Pharmaceuticals India Pvt ltd. Recently we applied to Roc with this new name (Getwell Pharmaceuticals India Pvt ltd) butROC refused to this name by the reason that this name is closely resemble to the Getwell Pharmaceuticals pvt ltd (1997 Uttar Pradesh). my question is that can we get the name of Getwell Pharmaceuticals India Pvt ltd by any means.

i need your valuable suggestions Ca club india members

As per the name applicability guidelines if any 2 words (Other than Pvt Ltd) corresponds to any existing company name then it is deemed to be similar. In your case if you get an NOC from Getwell Pharmaceuticals pvt ltd (1997 Uttar Pradesh) for incorporating a company in the Name of Getwell Pharmaceuticals India pvt ltd, then the said name may be alloted to you by ROC.

Dear sumit,

Firstly thanks for your suggestion and secondly i heard about that if we have a registered logo different from him then we have chance to get the propsed name...what you think about it.

Dear Sir

As per my view even if seperate logo is registered, the name you need is registered in UP with similar words. So if possible get an NOC and that will ensure that you get the name as desired.
