Loss in capital gains

Sir,

in the years between 1990-1994, i bought some Equity shares from different public issue companies. .i have not checked the status of shares till now. but as i recently opened a demat account, i tried to dematerialize my shares i now came to know most of them are not listed in BSE/ NSE.    any can i avail loss in capital gains. if so which Section do i need to fill in the ITR From2.

If you sell these shares through the stock market route, you wont be able to claim any loss as STT would be paid on these transactions. And Long Term Capital Gain arising through transactions on which STT has not been paid are exempt from payment of Taxes and the Loss cannot also be set-off.

 

However, in case you sell these shares not through the Stock Market route but other offline channels, you would be able to claim set-off of Loss
