25 July 2012Do the liability of employer to deduct TDS (on salaries) still exists , if the employee pays advance tax by himself & balance tax payable by employee will be zero ?
If the employee paid advance tax by himself & if the employers does not deduct TDS on his salary, will the salary expenditure to employer is allowed U/s 40(a)(ia) ?

If you have paid the advance ta on your own & your tax liability for the year is nil then no need by the employer to deduct tax. However inform your employer that you have paid advacne tax so that he would not deduct any more tax, otherwise he will also deduct tax and then you would have to claim the refund for no reason.
