Intimation under 1431a

Tax queries 450 views 9 replies

Dear Sir,

I have received demand notice under section 1431a for AY 2010-2011.

The outstanding amount is Rs 12970/=.

Actually I never noticed pending action tab until my colleague pointing out to me.

I don't have any documents for the same. I changed my company that year along with my residence and I have given my ITR filing to a CA.

I think due to some mistake in calculation I have got this demand notice.

But without any document I cannot do anything. I only have demand notice (Tax computation sheet) which is attached to the outstanding demand column.

Kindly suggest what should I do. Shall I proceed with payment.

Regards

Sandip Kumar

Yes, without any clear evidence it cannot be reduced/nullify.

Dear Sir, You mean to say I should proceed with payment. Thanks and Regards, Sandip Kumar

Yes, otherwise interest is adding on.

Dear Sir,

Thanks for suggestion.

I will proceed with payment.

So after payment , does it automatically gets cancelled or I have to meet AO.

Thanks and Regards,

Sandip Kumar

It will get cancelled in due course of time, with new demand for interest over delayed payment for period of demand raised to payment made. But no other option!!

Just now made payment.
Mr. sandip, mainly the demand might be due to TDS mismatch... if possible, request for 143(1a) intimation notice... from intimation notice, try to find out whether credit has been given to TDS amount, if not, you can file for rectification though the time limitation has already expired but still you can file condonation request for rectification

Dear Sir,

I have paid the demand and waiting for it to appear in Form 26AS.

I have submitted response - agree to demand.

It was a manual filing and it was uploaded by AO and rectification rights are also with AO.

Do I need to inform AO by mail, letter or by meeting personally, that demand has been paid. Or after submitting the response the demand status automatically gets updated.

Kindly update

Thanks and Regards,

Sandip Kumar

Generally it takes about 10 working days to reflect in form 26AS, and may take about a month to get it removed from the site.

Wait and watch. You may report under Grievance if it is not removed after 30 days. No need to meet AO at this stage.
