HRA deduction

we are staying in a rented house and my husband is paying house rent, but he is not claiming his rent paid in his return, i am drawing salary from a company and getting HRA in my salary.

now my question is, can i claim house rent paid by my husband as a deduction aqainst HRA, in my return?

Aashima,

Sec 10(13A) provides exemption to HRA in respect of house rent expenditure actually incurred.

In case you are able to secure the rent receipts from the landlord in your name though the rent has actually been paid by your husband, you can surely claim it.
