If the builder is not completing the work. That is why the amount is pending from bankers side.
The statement of Builder is wrong. You need not pay any GST on that amount.

@ sharad: For builder......... for unsold flats/units...... i.e. stock in trade...... no depriciation allowed.
For fixed assets depreciation of commercial bulding is taken as 10% as per IT act.......

If already Sale Deed Registered then there is no requirement to pay GST. Buider require to due Service Tax Liability as on Sale Deed Registered Date.
