First half TDS deducted, other half not, same employer. He need to provide Form 16 A for whole year or not?

the employer has to provide form 16 forbthe period for which the employee was with the employer incorporating all the amount of salary paid. The period is not for the period for which tax was deducted but for the period for which salary as paid

But that income was not taxable, earlier they deducted under Section 194J. So they are saying that as the tax is not deducted, no form 16 can be issued.
