Tax on foreign income

Dear Friends,

I have few  question related to income tax on foreign Income.

I came to USA on March 9 2015 as part of my employment and I will be here till Oct 10 , 2015 and then will be back to ndia

1) As per these dates my period of stay in India for the year 2015 - 16 will be around  173 days. So I would be considerd as an NRI for this year .   But,  next month I am planning to come to India  on leave for 2 weeks for some personal work. So, does this period of stay will also be counted  for the 182 days NRI crediteria?

2) If  I will be the resdient of India for the year 2015-16 , how is my IT  gets computed. Is it only on the amount that I transferr from USA to India  or my complete salary will be converted in to INR for tax computation?

Please help me on this.

Thanks in advance.

Gopi...

The person is considered as resident in case of Employment if he stays in India for the Period of 182days or more in any Financial Year, the period of stay in contiously or break is totalled for calculation of 182 Days.

and any money received or deemed to be receivded in India is taxable in India.

In the instant case the the asseese will be considered as resident if he stays in India for the period in Break or continousliy for 182Days or More and any money received by him in India in form of transfer or any othersource will be taxable in India

Thanks yogesh.

any money received by him in India in form of transfer or any othersource will be taxable in India.

Does this mean that amount transferred to India only will be taxed irrespective of my salary in USA?

Yes amount received in India will be taxable.

But if you are holding any bank Account or any asset in foreign country should be disclosed mandatorily.
