Tax queries 1768 views 3 replies

Hi All,

Would like to have your valuable opnions on the below query.

I am a software professional and visited US twice on work permit from Apr'13 - March 2014. Combining two trips i was in US for 5 1/2 months (175 days). I was sent on employment transfer and i was not getting any salary in India. Please let me know whether i should show my onsite income while filing the taxes.

If i suppose to show the income while filing taxes would you please provide some guidelines for computing the taxes and etc.,

Thanks in advance!

Regards,

Ram

Dear Ram,

you are there in foreign less than 182 days in FY 13-14 hence you are resident only for FY 13-14. Full amount you are earned in US is taxable in India

Thanks praveen.

Let me know if some articles that would help me compute the taxes to be paid to get some peace of mind. Will reach out to Auditor too this weekend.

Your salary earned in USA will be taxable in India as well as your residential status is ROR for Income Tax purposes assuming that you were in India before April 2013. While filing your ITR show the same under the head Income from Salary. If any tax has been deducted in USA, relief for the same can be claimed u/s 90. The exact tax liability under Income Tax Act can be figured out only if the components of salary and the figures are known.
