in our case the STO has Imposed Penalty u/s 29(3) of the MVAT Act for not attending the case on hearing. can we waive off such penalty by giving appropriate reason for not attending on hearing or by any other way pls do reply.

Go in for an Appeal & Provide a Doctors Certificate of either the Consultant or the Owner (Assessee) for the day / Dates which you did not attend & Officer levied Penalty for the same, & based on the Medical Certificate the Appealate Authority will waive off the Penalty
