I have made a deposit account with a nationalised bank  in the finacial year 2008-09 with accumulation of interest on cumulative basis;the deposit got matured in April 2012;  i instructed the bank to credit the proceeds in my SB a/c with them; on verification of the sb a/c i noticed that there is a short credit of Rs.3113/-when i asked for the reason they said that they have deducted TDS during AY 2009-10 and 2010-11; neither i was told orally nor iwas provided with Form 16 at the time of TDS;they are not able to give a convincing reply;added they did not credit the TDS to Govt account soon after deduction as could be seen from Form 26AS;On pointing out all these irregularities they now booked the TDS in Form 26AS for AY 2009-10 & 2010-11 on 12/04/2012 .Now the Form 26AS for the above A.Years reflects a TDS booking done on 12/4/2012; they say that i can now claim for refund from Incometax Dept;Pl. let me know whether i can get refund? ifso how to claim?

Did you file the income-tax return for the AY 2009-2010 and 2010-2011. If yes, had you disclosed the interest income in your return?

Yes; i have filed returns for bothe the AY; since i was not provided with any document by the bank for the int paid; hence  i could not include the interest in the returns

you have the rights to collect form 16A from the bank, , for A.y 09-10,10-11 did u applied for refund???, if u applied for refund then u ll get it 

when the Bank has credited the TDS for Ay 2009-10 & 2010-11 to Govt account only on 12/04/2012  how can i apply for refund when thee is no entry in Form 26AS during 2009-10?

AS THEY DEDUCTED TDS ON DT. 12.04.2012, FOR INTEREST OF THE A.Y. 2009-2010 & 2010-2011, SO, FROM 26AS REFLECT YOUR TDS AMOUNT RS.3113/- AFTER THEY SUBMIT RETURN OF 1ST QUARTER FOR A.Y. 2013-2014 (i.e.. AFTER 15 JULY 2012), YOU MAY CLAIM TDS AMOUNT AT THE TIME OF SUBMISSION OF YOUR RETURN FOR SAID A.Y.

sorry to intervane but this problems mostly arise to number of peoples, Govt banks and also pvt banks working in this regard is very poor . Why the department not takes action against bank ? why deductee suffers ?

DEAR, YOU CAN FILE RECTIFICATION U/S 154 / 155 PROVIDED THAT YOU HAVE FILED YOUR ITR OFR RESPECTIVE YEARS ELECTRONICALY.

thank q ; kindly let me know whether the rectification form under sec 154/155 of it act  is available for download or i can file the same onlone also; if yes pl. guide me the relevant website ;

As per guidline of RBI Bank sent TDS Certificate on or before 30 June every year. you should go for consumer forum for fail of service & Banking odmumtion & rectife your reteen get refund with in 60 days
