Tds on rent

Clarity neede:

I pay rent 2,40,000 pa to my father.  He shows 50% as rental income for his wife (my mother).

  1. Should I deduct TDS & pay 2,40,000?
  2. If yes, TDS @ what%?
  3. Any way to avoid deduction of TDS?  House is in name of my father & mother, equal share.

If rental income shown as RS 120000 in name of your father and mother individually ,then TDS will not apply

TDS will apply only if rental income exceeds RS 180000 for each co owner of property

Hence no tds

  • You must deduct TDS as applicable at times.
  • Your father must show the ITR to Department and get the refund.
