Deemed completion of articleship

There was an Articled assistant in our firm who's articleship commenced on 24/04/2007. But due to some reasons she stopped coming to the office and till date we are not able to track her. But in the Member's list of Articles registered, the above person's name is still mentioned due to which fresh article in place of her could not be registered. Her articleship was due to complete on 23/04/2010.

An article had registered under the member 6 months back and the registeration got rejected asking him to register himself under a different CA and submit fresh form of articleship form because there are 10 students already registered under the member. If we don't do anything his attempt of CA final will be delayed.

I want to know whether anything can be done w.r.t. to the article who's articlehship was due to complete on 23/04/2010 and save the registration of the new article.

With due respect, the concern CA must write a letter to ICAI about the Candidate, that his/her whereabout is not known...not coming to office....so kindly take away the name in the articles list under him and make a way to admit new article trainee instead of him.

IT MUST BE DONE A LONG WAY BACK. i.e atleast 2 months of absence of the concern candidate whose whereabouts not known.

If that happened, ICAI will sent a letter to concern article askin for reason..and says if nothing turned..ur name will removed from article register...

Now its in the hands of CA. He must write a detail letter to ICAI stating the reasons and request them to cut off the name and admit new one..

Normally ICAI takes time... If CA knows someone inside ICAI office..it can be done...or else definietly its possible to cut the name and admit one..but time matters..

The reason being even it can be taken as Deemed completion...official record i,e form 109 of completion of training is not there to drop down the candidate.. hope u understand...

If your friend feels exam is delaying...ask him/her to go for another CA....or else at the time of letter submission / In person appearance of CA to ICAI in the matter, this situation of the new candidate must be mentioned and give supportings of the attendance..his work diary etc...to prove that this new article trainee is active from the date mentioned....his application rejected due to this old candidate problem...

Definitely it will be solved...its in the CAs hand...
