Dear All,

During our excise & service tax audit, excise department is disallowed the credit of service tax paid on group insurance policy taken by the the company for contract labour.

The department contension is that the in the above caes, service tax credit available if he is a company employee. Hence please tell us that contarctor labour is company employee or not???? If yes, please provide us the references.

Buying of Group Policies is to protect both management and insured persons from unforseen expenses. The health of insured persons enable the management to be in business. 

Disallowing Credit of Service Tax is not borne out of the facts. Credit for Service Tax on Group Insurance Policies should be allowed.

The Excise Inspectors should be hanged for this.  The statute mandates strict compliance and when we comply, we face music from som inefficient officers.
