Cenvat credits of ssi unit.

A newly incorporated company is setting up a plant which will become operational in Jan'2017. The company doesn't want to take excise registration and wants to operate under E/N 8/2003 (SSI). Whether credit of CVD and Special CVD will be allowed if the assessee doesn't take excise registration and wants to avail credit under GST?

Exc ise registration is compulsory for availling credit of CVD and special CVD. The assesse can take registration in Excise and this registration would automatically be considered for registration of GST.

Registration under CE not required mandatorily for availing credit at later periods. Pre registration credits are available subject to time limit.

However under GST no credit is available without registration. Therefore as a measure of caution , SSI can however apply for registration before March 17 and avail the 100% credit and carry it forward.
