Is it essential the submission of income tax return for previous years to claim 10E rebate on arrears? If return is not filed what should do

As return of the earlier year is not filed, arrears claim u/s. 89(1) is not accepted by CPC, as such it is taxable in year of receipt, unless the form16 of both years indicate salaries of respective years.

Yes, file may be trasferred to Jurisdictional ITO in that case.

One got ₹65000 as salary arrears 35000 of 2015-16and balance 2016-17. Can he claim10E exception for 2015-16 only for ₹35000 without claiming balance amount of 2016-17
