ManojWrote on 20 June 2012Dear Sir, Very Good Article. I am a facing a similar situation. Would be thankful to you, if you can address my query. My case is as under My client has entered into a deal for ( Entire building)office premises with a builder. Deal value is 50 Crores ( Inclusive of land plus construction cost). Builder has provided land as well as he is constructing 3 floors and will be giving ready possession to my client. Construction has started in 2008 and it is still going on. My client made advance payment based on milestones achieved as per Agreement to Sale ( Final Sale Deed is pending) My query is 1) Whether builder will charge service tax & from which date? 2) Whether he will charge Service tax as well as Vat ? 3) He will only charge VAT ?
