19 June 2015We are in Construction business and currently we are doing a building work which will be used as school.So my question is according to the Notification No. 25/2012-Service Tax Sr No- 9
Services provided to or by an educational institution in respect of education exempted from service tax, by way of,-
(a) auxiliary educational services; or
(b) renting of immovable property;
Will we be able to get exemption?????

Entry Number 12(c) in E/N 25/2012 has been omitted w.e.f. 01.04.2015 by way of NN 06/2015-ST dated 01.03.2015. If your case is one of those, then this service has brought under tax net now.
For Point of Taxation which falls on or after 01.04.2015, service is taxable.
Entry stated by you is not applicable on you , as you are constructing the building.

No exemption, but you can take benefit of abatement if you are providing works contract service.
