implementation of biometric-based Aadhaar authentication for GST registration. The key points include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Biometric Aadhaar authentication will be introduced in across India.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>New GST registrations will require Aadhaar biometric authentication.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>FM Sitharaman said that this measure will help to address issues related to fraudulent input tax credit claims.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_biometric-based_Aadhaar_authentication_for_GST_registration\"><\/span>What is biometric-based Aadhaar authentication for GST registration?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Biometric-based Aadhaar authentication for GST registration means verifying an applicant&#8217;s identity using their <a href=\"https:\/\/www.caclubindia.com\/articles\/aadhaar-card-enrol-download-status-50169.asp#google_vignette\">Aadhaar<\/a>-linked fingerprints or iris scan to ensure authenticity and prevent fraud in the GST registration process.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rule_on_Aadhaar_Authentication_for_GST_Registration\"><\/span>Rule on Aadhaar Authentication for GST Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Opt-in_for_Aadhaar_Authentication\"><\/span>Opt-in for Aadhaar Authentication<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>When an applicant apply for GST registration can choose Aadhaar authentication, except for those exempted by the Central government or those mandated to authenticate under Section 25(6C) of the CGST Act.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_Authentication_Period\"><\/span>Mandatory Authentication Period<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>From April 1, 2020, to August 20, 2020, Aadhaar authentication was mandatory for all registration applications.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>From August 21, 2020, onwards, opting for Aadhaar authentication became a choice.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Authentication_Process_in_GST_Registration\"><\/span>Authentication Process in GST Registration<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Submit Aadhaar number with the GST registration application.<\/li>\n<\/ul>\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" title=\"Aadhaar Authentication for GST Registration\" class=\"wp-block-list\">\n<li>E-verify using an OTP sent to the Aadhaar-linked mobile number and email.<\/li>\n<\/ul>\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" title=\"Aadhaar Authentication for GST Registration\" src=\"https:\/\/www.caclubindia.com\/guide\/wp-content\/uploads\/2024\/06\/adhaar2.png\" alt=\"Aadhaar Authentication for GST Registration\" \/><\/figure>\n\n\n<ul class=\"wp-block-list\">\n<li>Aadhaar authentication is required for the primary authorized signatory and at least one promoter or partner.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For entities like companies, LLPs, foreign companies, AOPs, societies, trusts, or clubs, only the primary authorized signatory needs to be authenticated.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Post-Authentication\"><\/span>Post-Authentication<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>After successful authentication, an OTP will be required for future filings on the GST portal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Failure_to_Authenticate\"><\/span>Failure to Authenticate<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If Aadhaar authentication is not completed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The application can proceed without it.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Registration will be granted after physical verification of the business premises by a GST officer or e-KYC verification with approval from a higher-ranking officer.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Notification_and_Response\"><\/span>Notification and Response<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A notice (Form GST REG-3) is issued within 21 days if authentication fails.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The applicant must respond within 7 working days (Form GST REG-4).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The officer has 7 days to approve or reject the application.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Physical_Verification\"><\/span>Physical Verification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If Aadhaar is not available, physical verification of the business premises will be conducted within 60 days from the application date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_Aadhaar_Authentication\"><\/span>Mandatory Aadhaar Authentication<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under Section 25(6C) of the CGST Act, the Aadhaar authentication is essential for the following class of individuals as per Rule 8 of the CGST Act in order to become eligible for for the GST enrollment:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Authorized signatories of all types.<\/li>\n\n\n\n<li>Managing\/authorized partners of a partnership firm.<\/li>\n\n\n\n<li>Karta of a Hindu Undivided Family (HUF).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Exceptions\"><\/span>Exceptions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Non-citizens of India or individuals other than those listed (e.g., authorized signatories, partners, Karta) are exempt from mandatory Aadhaar authentication.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span Authentication for Existing Taxpayers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Login to the GST Portal with valid credentials i.e. your user id and password.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>After logging in a pop-up message window is displayed with the question &#8220;Aadhaar Authentication facility is available.
