Hi All,

I have query in Income Tax. One of my Client is earning Commission on Fixed Turnover but he is not an employee of the Company. Its purely commission on sales made by him. The Company is Limited Company and has deducted TDS of Rs.50000 and odd.

My client also pays commission to Various person from the above commission as they find the order for him and my client places order to company.

My client is not falling under Audit Cases, Hence he need not deduct Tax on commission further distributed to various person.

My question is can my client get refund of TDS to the extent commission further paid by him by deducting the same from  Income from Commission .

Please advice.

Regards

Nirmal
