No. TDS is a deduction of taxes for the income elements in the receipts. In service tax there is no income element, one is just charging it on behalf of the Govt.

No, Tax should not be deducted on the gross amount. The Service Tax is not an Income in the hands of payee which is liable for Income Tax. As such, the same should not be subjected to TDS.

service tax is a tax which are paid by the deductore to the govt it is a tax not a income of the deductee so govt liability is not taken for tds purpose

1.Income Tax Act and Service Tax laws are different laws so they do not attract double taxation.
2.If it is not done so and a person is not covered under Service Tax Laws, his TDS rate on gross ammount will flactuate.
