Can anyone help me out in the following VAT clarifications

I have purchased a flat 9 months ago and its in construction. My builder is charging me VAT of 5% for the materials he purchased.

He says he is paying VAT to the government and he inturn collects the paid VAT from me. 

 I want to know whether the VAT should be borne by the builder or customer ?
