Dear all,

My client is registered owner of trademark "wellwish" and engaged in the business of furniture manufacturing and sales on national as well as international level with the name wellwish furniture pvt. Ltd. It is registred in all 32 classes under the trademark Act with the trademark "wellwish". A company is incorporated recently with the name "wellwish" tiles Pvt. Ltd. Though the business are different, my company wants to object to the name of said company on the ground that it has registeretd trademark even in the business of the said company. How far it is possible and permissible under section 22 of companies act, 1956 to obtain directions for change of name of the said company? Kindly give your views with supporting case laws. I will be really thankful for such guidance.
