can i efile the IT return of our company while the 3CD, 10CCB and 3CEB report have not been signed yet. Shall incometaxindiaefilling shall allow me to file IT return on the basis of provisional account and without filling 3CD, 10CCB and 3CEB reports?

these forms are to be submitted electronically ( with digital signature), no physical signature is needed

sir, i mean the 3CD report etc are not finalied yet... hence not signed.... an auditor shall not upload unfinalised report
now read my qtn again please - can i efile IT return without having uploaded 3CD, 10CCB etc reports?

without these report the return is rejected usually, so let the auditor uplod the reports first then uplod the return, mentioning the uplod reference of 3cd

in that such case, please suppose the worst. The auditor did not finalise and sign the report (cause BOD has not accepted the statutory audit reports) then can i file IT return mannually to respective AO office

Actuallty Income tax return asks both for Audit Date and date of furnishing the audit report. last date for filing the audit report was 31.10.2015 so you are already late. If auditor has given their report with qualifications then Board has to accept the report. because reort is meant for shareholder's and not for BOD. Bod has to provide their comment on auditors report.

worst is not there
department may initiate the audit again by their recomended auditor at the cost of assesee, and panalty / fine / interest would get levied upto that date of finalisation,
so better to wait for now and get reports finalized by the auditor, as the last date is already over

companies having audit report in 3CEB (Rule 10 E) is rerquired to file return up to 30.11.2015. so sitll there is dates.
now qtn is that at the worst if audit report is not finaslied, can company file return mannual to the corresponding AO
