Due date of agm

631 views 3 replies

According to Section 166, the gap between two AGM's can be of 15 months and one AGM should be held in every calendar year. According to Section 210, AGM should be held withon 6 months of finalising the accounts of the Company.

I want to know while calculating the due date of AGM whether these provisions are applicable as which date occurs later or earlier??

as per my knowledge it is applicable.

if approval taken 15 month can be extended to 18 months. so the provision of 6 month from finalising the account is inserted

On harmonius interpretation of both the provisions the only concluion drawn can be is the "THE DATE WHICH IS EARLIER".

The same is answered based on assumption that htere is no delay in AGM (i.e beyond due date)
