I need information regarding the filing of income tax.  I am an Indian citizen working on a cruise ship. My salary is paid in US dollars. I am typically away from my home for 4-5 month contracts and return home for 6 week vacations in between. As a result, I am outside of India for the majority of the year.  My question is, am I required to pay income tax in India or is my income considered tax-exempt based on my time spent outside the country?

I assume that I am considered an NRI, but am unsure of if I need to file an income tax return.


Appreciate any help. Thanks.

Are u on an indian ship?

 

If yes, then your salary will be exempt  from tax, provided you have not been in india for 182 days or more in Indian territory during the financial year, including the day of arrival and departure of the ship.

 

Also hope that your salary was not paid by Indian Government....

No, it is not an Indian ship. It's a big cruise line, Princess, and sails out of various US and European ports.

Ok... so that exemption is nt available to u... but still it can be exempt....

Have you been in India for 182 days or more (in total) during the concerned financial year, including date of arrival and departure???

No, I am in India for no more than 100 days during the last year.

Dear Jaskari,

 

If you are leaving India for employment abroad, then you will be considered as resident,

only if you have been in Indian Territory for 182 days or more during EACH particular financial year...

 

Hence since u have been outside india for the sufficient period, your salary cannot be taxed in India... You are non resident... and salary earned outside india by you cannot be subject to Income tax...

However, u have to check if ur salary is taxable in other countries....
