Amendment in Provident Fund Scheme - International worker

On 1st October, 2008, an amendment has been made in the Provident Fund Scheme whereby a new concept of the International worker has been brought in. Foreigners wokring in In dia will now subject to PF contribution.

Normally in case of the forigners, there is no concept of the basic salary and the emoluments of the foreigners is more then Rs. 6,500/-. Suppose a international worker is getting around Rs. 350,000 p.m. and is also contributing in Social Secirty in Japan, will he be liable to pay Provident fund in India and if yes on what amount Rs. 350,000 or Rs. 6,500.

If employee is in India for less then six months and his salary is not charged to Indian accounts of the foreign company (though registered with EPF authorities) whether contribution will be payable or not?.

Please clarify?

In some newsletters issued by the Big Four Firms it seems that this is draft amedment. Whether this has come into force or not.
