05 May 2016 One of my friends Grandfather died. they have a fd of rs. 500000. on fd interest was received but tds on interest was deducted.
my friend already close the grandfathers bank account.
now he wants to claim the tds refund, but the problem is that 3 sons are the legal guardian.
who file the income tax return on behalf of them?
whom bank account no. will be given?
& if dispute between the sons then what will be do in this matter??

05 May 2016 Any one legal heir can file tax return by register as legal Heir do E-Filing on behalf of the deceased, the legal representative will have to file returns in the deceased name for Income earned to till date.

legal representative has to register by legal heir certificate issued by court of law or Registered will,Family pension certificate .copy of death certificate , copy of PAN card of deceased, If they get approval than they can file return by login as legal Heir.

06 May 2016 Refund can be claimed only by filing return of income. and that can be filed for the deceased by his legal heir who is registered as such on e-filing website. Then refund can be claimed in legal heir's bank account.

06 May 2016 you can fiel return as legal heir. for that you can apply on incometaxefiling.gov.in site and make himself as legal heir.and also you have to make legal heir certificat for future benefits. and you can file the ITR of you grandfather with his PAN. and claim the refund of tds if any.
