30 April 2013 Till date my ITR filing for AY 2010-11 is balance and their is a refund of Rs 40K please suggest now it is possible to file ITR for AY 2010-11 and how ?

30 April 2013 now you are too late.
in my opinion the last date for valid return filing, was 31.3.2012 with a penalty of 5000.
but now that too has been missed.

in such situation people uses unethical ways by going to the department and to get the work done by the department's clerk etc.

though i won't suggest that.. hope u got it

01 May 2013 Please file a petition to the Commissioner of Income tax seeking to give direction to the ITO to accept the return and issue refund.

Ref:- Section 119 (2)(b) and circular 8/2001 dated 16/05/2001

13 June 2013 You can file your return physically claiming the refund and it is permitted. The return shall be processed by the ITO if the refund is below 10,000/- if it exceeds then by CIT

17 July 2013 Thank you very much sir for your suggestions, I have tried to file return physically, but it is not accpeting without 5000/- penalty. Can it is required to pay 5000/- penalty ?
