1)       Procedure for setting up a SEZ (Section 3 and Rule 4)

A Special Economic Zone may be established, either jointly or severally by the Central Government, State Government or any person for manufacture of goods or rendering services or for both or as a Free Trade and Warehousing Zone.

In the case of privately developed zones, the investors could be either Indian individuals, NRIs, Indian or foreign companies.

2)   Application for setting up SEZ

Any person, who intends to set up a Special Economic Zone, may, after identifying the area make a proposal in Form A to either of the following

a)      State Government concerned

      OR

b)      Board of Approval

a)   The State Government shall forward the proposals received to the Board of  Approval (Deputy Secretary, Ministry of Commerce and Industry, Department of Commerce, Udyog Bhavan, New Delhi – 110011) along with its recommendations, within forty-five days of receipt of such proposal:

b)   Board of Approval for the purpose of setting up the Special Economic Zone and after that obtain the concurrence of Sate Government with in six months  Central Government may suo moto set up and notify the Special Economic Zone

(a)  After consulting the State Government concerned;

(b)  Without referring the proposal for setting up the Special Economic Zone to the Board; and

(c)  After identifying the area;

There are no application fees for applying for setting up of SEZ
